Terms and Conditions
Welcome to our Charity Auction Website (“the Platform”). Before using our services, please carefully read and understand the following Terms and Conditions. By accessing or using the Platform, you agree to comply with these terms. If you do not agree with these terms, please do not use the Platform.
1. Platform Cost: For charity auction fundraisers, the Platform charges a fee of 10% of the total funds raised through the auction. This fee will be deducted from the final amount claimed by the fundraiser.
2. Delivery Cost: A fixed delivery cost of Ksh 500 will be applied to the sale of goods. This cost will be borne by the fundraiser. If the delivery cost is above this, the platform will top up the amount
3. Buy Now Pay Later Program: If your fundraiser is approved for the ‘buy now pay later’ program, No additional costs will apply.
4. Marketing Efforts: The fundraiser is solely responsible for all marketing efforts required to promote the auction. The Platform does not provide marketing services or assistance.
5. Truthful Information: The fundraiser must provide accurate and truthful information regarding the items or services being auctioned. Misrepresentation or false information may lead to account suspension or legal action.
6. Charity Coins: Please note that any money used to purchase charity coins is considered non-refundable. Charity coins refunded to bidders are reusable to bid on any charity auction. These charity coins are directly channeled to support the designated fundraiser and its charitable initiatives. We deeply appreciate your commitment to making a positive impact through your contributions.
7. In the event that a charity auction does not reach its fundraising goal or is deemed unsuccessful, all purchased charity coins will be promptly refunded to the respective bidders’ platform accounts. Our priority is to ensure a fair and transparent process for all participants, even in the face of unforeseen circumstances. Bidders may use the funds to bid again or on any cause available on the platform.
An example of a failed auction is where a fundraiser is unable to raise the auction item costs on our ‘pay now buy later’ option.
8. Copyright and Usage: By providing any material, information, images, or content for the auction, the fundraiser grants the Platform a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute the provided material for promotional purposes on the Platform and related marketing channels. The fundraiser affirms that they have the right to use and share any copyrighted material.
9. Fundraiser’s Obligations: The fundraiser agrees to abide by all applicable laws and regulations and to conduct themselves in an ethical and professional manner throughout the auction process.
10. Withdrawable Funds: Only the funds raised through successful bids will be claimable from the Platform. In addition, If One bidder makes 2 bids, this is calculated as 1 bid, since bidders only pay once to bid on an auction. Note that the money paid by the winning bidder towards the auction item is not considered as withdrawable. Partial withdrawals are allowed as long as platform costs have been achieved.
11. Dispute Resolution: In the event of any disputes between the fundraiser and winning bidders, the Platform reserves the right to mediate and facilitate resolution.
12. Modification of Terms: The Platform reserves the right to modify, update, or revise these Terms and Conditions at any time. Users will be notified of any changes, and continued use of the Platform constitutes acceptance of the modified terms.
13. Termination: The Platform reserves the right to suspend or terminate a fundraiser’s account at its discretion if there is a breach of these Terms and Conditions or if the fundraiser’s actions are deemed harmful or inappropriate. In this case the charity coins bought on the auction will be refunded to the bidders.
